Terms of Service

These Terms of Service apply to all purchases and services from Webco, LLC, doing business as Durable Flags ("Durable Flags," "we," "us"), through durableflags.com, our Omaha retail location, or by phone or email. By placing an order or using our website, you agree to these terms.

1. Products and pricing

We work to keep product descriptions, images, and prices accurate, but errors can happen. Colors may vary slightly from what appears on your screen. We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price, with a full refund. Prices and availability may change without notice.

2. Orders and payment

An order is accepted when we confirm it, not when it's placed. We may decline or cancel any order, including for suspected fraud or limited stock. Unless you have approved credit terms on a business account, payment is due at the time of purchase.

3. Business accounts

Business account applications are subject to approval. Account pricing is confidential and may not be shared or used for resale without our written permission. Invoices on approved terms are due as stated on the invoice. Past-due balances may result in suspended account privileges, and we may charge 1.5% monthly interest on overdue amounts, or the maximum allowed by law if lower.

4. Shipping and pickup

In-stock orders typically ship within one business day. Delivery dates from carriers are estimates, and we aren't responsible for carrier delays. Risk of loss passes to you when the order is delivered or picked up. See our Shipping Policy for current rates and free-shipping terms.

5. Custom orders and artwork

Custom flags and banners are produced to the specifications and artwork you provide or approve. By submitting artwork, you confirm that you own it or have permission to use it, and you agree to hold us harmless from any claim that it infringes someone else's rights. We may decline any design at our discretion.

You're responsible for reviewing your proof carefully, including spelling, colors, and dimensions. Once you approve a proof, production begins and the order can't be changed or canceled. Lead times are estimates and begin after proof approval. Printed colors may vary slightly from screen colors and PMS references.

6. Installation and on-site services

On-site services are available within approximately 60 miles of Omaha and are quoted in advance. Quotes are valid for 30 days. You're responsible for providing safe access to the work area and for identifying any private underground utilities, sprinkler lines, or other hidden obstructions. We'll request a utility locate before digging, but we aren't responsible for damage to unmarked private lines.

You're responsible for obtaining any HOA approval, landlord permission, or permits required for your property, unless our quote states otherwise. Schedules may change due to weather or site conditions.

7. Warranties

Manufacturer warranties apply to products as stated by each manufacturer, and we'll help you file claims. Flag lifespan varies with weather, wind, pole height, and care, so we don't guarantee any specific lifespan. Except as stated in these terms or required by law, products and services are provided "as is," and we disclaim all other warranties, express or implied.

8. Limitation of liability

To the fullest extent allowed by law, our total liability for any claim related to a product or service is limited to the amount you paid for it. We aren't liable for indirect, incidental, or consequential damages. This doesn't limit any rights you have that can't be waived under applicable law.

9. Website use

All website content, including text, images, logos, and our patented reinforcement process descriptions, belongs to Durable Flags or its licensors and may not be copied without permission. You agree not to misuse the website or interfere with its operation.

10. Email communications

If you sign up for emails, such as our half-staff alerts, you can unsubscribe at any time using the link in any email.

11. Governing law

These terms are governed by the laws of the State of Nebraska. Any dispute will be resolved in the state or federal courts located in Douglas County, Nebraska.

12. Changes to these terms

We may update these terms from time to time. The version posted on our website at the time of your order applies to that order.
